In accordance with current legislation, Parque la Maleza (hereinafter also referred to as the “Website”) undertakes to adopt the technical and organizational measures required, in line with the appropriate level of security for the risk posed by the data collected.
Laws incorporated in this privacy policy
This privacy policy is adapted to the current Spanish and European regulations on the protection of personal data on the internet. Specifically, it complies with the following rules:

Personal Data Register
In compliance with the GDPR and the LOPD-GDD, we inform you that the personal data collected by Parque la Maleza through the forms available on its pages will be incorporated and processed in our records in order to facilitate, streamline and fulfill the commitments established between Parque la Maleza and the User, or to maintain the relationship established through the forms completed by the User, or to respond to a request or query. Likewise, in accordance with the GDPR and the LOPD-GDD, unless the exception provided in Article 30.5 of the GDPR applies, a record of processing activities is maintained, specifying, according to its purposes, the processing activities carried out and the other circumstances established in the GDPR.
Principles applicable to the processing of personal data
The processing of the User’s personal data shall be subject to the following principles set out in Article 5 of the GDPR and in Article 4 et seq. of Organic Law 3/2018 of 5 December:

Categories of personal data
The categories of data processed on Parque la Maleza are identification data only. In no case are special categories of personal data processed within the meaning of Article 9 of the GDPR.
Legal basis for processing personal data
The legal basis for the processing of personal data is consent. Parque la Maleza undertakes to obtain the User’s express and verifiable consent for the processing of their personal data for one or more specific purposes.
The User has the right to withdraw their consent at any time. Withdrawing consent will be as easy as giving it. As a general rule, withdrawal of consent will not affect use of the Website.
When the User must or may provide data through forms to make queries, request information, or for reasons related to the Website content, the User will be informed if completing any of them is mandatory because it is essential for the proper performance of the relevant operation.
Purposes of processing
Personal data is collected and managed by Parque la Maleza in order to facilitate, streamline and fulfill the commitments established between the Website and the User, or to maintain the relationship established through the forms completed by the User, or to respond to a request or query.

Retention periods for personal data

Personal data of minors
In accordance with Articles 8 of the GDPR and 7 of Organic Law 3/2018 of 5 December, only those over 14 years of age may lawfully consent to the processing of their personal data by Parque la Maleza. If the User is under 14, parental or guardian consent will be required, and the processing will only be lawful to the extent that it has been authorized.
Data secrecy and security
Parque la Maleza undertakes to adopt the necessary technical and organizational measures, according to an appropriate level of security for the risk of the data collected, to ensure the security of personal data and prevent accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorized disclosure or access.
However, since Parque la Maleza cannot guarantee the absolute security of the internet or the total absence of hackers or others who fraudulently access personal data, the Controller undertakes to notify the User without undue delay when a personal data breach occurs that is likely to result in a high risk to the rights and freedoms of natural persons. In accordance with Article 4 of the GDPR, a personal data breach means any breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed.
Personal data will be treated as confidential by the Controller, who undertakes to inform and ensure, through a legal or contractual obligation, that such confidentiality is respected by employees, associates, and any person to whom the information is made accessible.
Rights arising from the processing of personal data
The User has the following rights, recognized in the GDPR and Organic Law 3/2018:

Right of access: to obtain confirmation as to whether Parque la Maleza processes personal data and, where applicable, access to such data and information about the processing.

Right to rectification: to have inaccurate or incomplete personal data corrected.

Right to erasure (“right to be forgotten”): to have personal data erased when it is no longer necessary, consent is withdrawn and there is no other legal basis, the User objects and there are no overriding legitimate grounds, the data has been unlawfully processed, the data must be erased to comply with a legal obligation, or it was obtained from a direct offer of information society services to a child under 14. In addition, the Controller shall take reasonable steps to inform other controllers processing the data of the request to erase links to such personal data.

Right to restriction of processing: to restrict the processing in certain cases, such as contesting accuracy, unlawful processing, when the Controller no longer needs the data but the User needs it for claims, or when the User has objected to the processing.

Name and surname of the User and a copy of their ID. Where representation is permitted, identification of the representative and proof of representation will also be required. A photocopy of the ID may be replaced by any other legally valid means proving identity.

II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY
The User must have read and agree with the conditions on the protection of personal data contained in this Privacy Policy and must accept the processing of their personal data so that the Controller can process it in the manner, within the timeframes and for the purposes indicated. Use of the Website implies acceptance of the Website’s Privacy Policy.
Parque la Maleza reserves the right to modify its Privacy Policy, at its own discretion, or due to legislative, case law or doctrinal changes by the Spanish Data Protection Agency. Changes or updates to this Privacy Policy will not be explicitly notified to the User. Users are advised to consult this page periodically to stay informed of the latest changes or updates.
